Welcome to Tough Mother. These Terms of Service govern your use of toughmother.com and any purchase you make from us. The site is operated by Victory Garden, LLC ("Tough Mother," "we," "us," or "our").

By browsing this site or placing an order, you agree to these terms. If you do not agree, please do not use the site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By purchasing from us, you confirm you meet that requirement and that the payment method you use belongs to you or that you are authorized to use it.

2. Your account

You do not need an account to shop, but if you create one you are responsible for keeping your login details secure and for all activity that happens under it. Let us know at hello@toughmother.com if you believe your account has been accessed without your permission.

3. Products, pricing, and availability

We do our best to display our products accurately, but packaging, colors, and labels may vary slightly from the images on the site. Flavors and pack sizes may be limited, discontinued, or temporarily unavailable at any time.

Prices are listed in U.S. dollars and may change without notice. We reserve the right to correct pricing or product errors, including after an order has been submitted. If a listed price is clearly wrong, we may cancel the affected order and refund you in full.

4. Orders

Your order is an offer to buy. We may accept or decline any order for any lawful reason, including suspected fraud, resale activity, quantity limits, or errors in pricing or product information. If we decline your order after payment, we will refund you in full.

Once an order has been processed and handed to the carrier, it cannot be changed or cancelled. See our Return and Refund Policy for the full picture.

5. Payment

Payment is collected at checkout through our payment processor. By submitting an order you confirm the payment information you provide is accurate and that you are authorized to use it. We do not store full payment card details.

6. Shipping and risk of loss

We ship within the United States unless stated otherwise at checkout. Delivery estimates are estimates, not guarantees, and carrier delays are outside our control.

Title and risk of loss pass to you when the carrier confirms delivery. Our Return and Refund Policy explains how we handle delivery problems.

7. Returns and refunds

All returns, replacements, and refunds are governed by our Return and Refund Policy, which is part of these terms. Because we sell a perishable food product, we do not accept physical returns.

8. Food safety, allergens, and health information

Tough Mother Biltong is a food product made from beef. Please read the packaging before eating.

Our product is produced in a facility that also handles other food products. If you have a food allergy or sensitivity, review the ingredient statement on the pouch and contact us at hello@toughmother.com with any questions before ordering.

Nothing on this site is medical or nutritional advice. Statements about our product describe the food itself and are not intended to diagnose, treat, cure, or prevent any disease. Individual results vary. If you are pregnant, nursing, managing a medical condition, or following a prescribed diet, talk with your healthcare provider before making changes to what you eat.

Store and handle the product as directed on the packaging.

9. Promotions and discount codes

Discount codes, promotions, and giveaways may carry their own terms, expiration dates, and eligibility limits. Codes cannot be combined unless we say otherwise, hold no cash value, and may be modified or withdrawn at any time. We may void a code and cancel an order if we believe a code has been misused.

10. Email and text messages

If you sign up for our emails or texts, you consent to receive marketing messages from us. Message and data rates may apply. You can unsubscribe from emails at any time using the link in any message, and you can stop texts by replying STOP. Order and shipping notifications are transactional and are sent regardless of marketing preferences.

11. Reviews and submissions

If you post a review, photo, comment, or other content to our site or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in our marketing, with credit where appropriate. You confirm the content is yours to share and does not infringe anyone else's rights.

We may remove content that is unlawful, misleading, offensive, or unrelated to our products.

12. Intellectual property

The Tough Mother name, logo, packaging design, illustrations, photography, and written content on this site are owned by us or licensed to us and are protected by trademark and copyright law. You may not copy, reproduce, or use any of it for commercial purposes without our written permission.

13. Resale and third party sellers

Our products are sold for personal consumption. Purchase for resale or commercial distribution is not permitted without a written wholesale agreement with us.

We are not responsible for product bought from unauthorized resellers or third party marketplace sellers, and we cannot verify the condition, storage, or authenticity of product sold that way. Requests related to those purchases should go to the seller you bought from.

14. Acceptable use

You agree not to use this site to break the law, interfere with its operation or security, scrape or harvest data, submit false information, or attempt to gain unauthorized access to any part of it.

15. Third party links

Our site may link to other websites we do not control. We are not responsible for their content, products, or privacy practices.

16. Disclaimer of warranties

The site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error free.

Nothing in this section limits any warranty or right you have under applicable consumer protection law.

17. Limitation of liability

To the fullest extent permitted by law, Tough Mother and its owners, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or our products. Our total liability for any claim will not exceed the amount you paid for the order that gave rise to the claim.

Some states do not allow these limitations, so parts of this section may not apply to you.

18. Indemnification

You agree to indemnify and hold Tough Mother harmless from any claim, loss, or expense, including reasonable legal fees, arising from your misuse of the site, your breach of these terms, or your violation of any law or third party right.

19. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in the City of Alexandria, Virginia, and you consent to that jurisdiction.

20. Changes to these terms

We may update these terms at any time. The version posted here at the time of your order is the one that applies to it. Continued use of the site after we post changes means you accept the updated terms.

21. Severability

If any part of these terms is found unenforceable, the rest stays in effect.
